Changes to motor accident compensation since 2017
There has been a significant change in the rights to claim compensation for motor accidents since 2017. The Motor Accidents Injury Act 2017 contains specific time limits to lodge a personal injury claim.
The personal injury claim allows you to claim loss of wages, medical and care expenses. Previously claimants had a period of six months to lodge a claim form. This has been reduced to three months from the date of the accident.
If you are claiming for loss of wages, the claim for past loss of statutory wages must be made within 28 days. If you do not lodge the claim form within 28 days you are not entitled to have your wage loss back dated to the date of the accident.
The legislation empowers insurers to make decisions as to your entitlements including your entitlements to claim:
- Travel expenses;
- Degree of impairment;
- Earning capacity;
- Minor injury assessments;
- Damages claims;
- Exemptions from assessment;
- Lump sum approvals.
Seek legal advice
It is imperative to seek legal advice if the insurer has made a determination you do not agree with. If you do not agree with the decision an application for review must be made within 28 days.
In the majority of claims your legal costs will be capped and paid by the insurer.
