Changes To Motor Accident Compensation Since 2017

There has been a significant change in the rights to claim compensation for motor accidents since 2017. The Motor Accidents Injury Act 2017 contains specific time limits to lodge a personal injury claim.

The personal injury claim allows you to claim loss of wages, medical and care expenses. Previously, claimants had a period of six months in which to lodge a claim. This has been reduced to three months from the date of the accident.

If you are claiming for loss of wages, the claim for past loss of statutory wages must be made within 28 days. If you do not lodge the claim form within 28 days you are not entitled to have your wage loss backdated to the date of the accident.

The legislation empowers insurers to make decisions as to your entitlements, including your entitlements to claim:

• Travel expenses;
• Degree of impairment;
• Earning capacity;
• Minor injury assessments;
• Damages claims;
• Exemptions from assessment;
• Lump sum approvals.
